These Terms and Conditions govern the use of our website (the "Site"). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Site. If you have any questions on the Terms and Conditions, please contact us.
Supplementary Regulations
Sales
All sales are subject to our final confirmation. Once an invoice is raised and issued, the sale is considered final. No cancellations will be accepted. We reserve the right to apply a 5% restock fee of the goods value for any cancelled items. Prices are subject to change without notice. All wines are offered subject to remaining unsold. Unless stated otherwise, all wines are offered lying in Hong Kong. Under the law of Hong Kong, intoxicating liquor must not be sold or supplied to a minor in the course of business. By proceeding with this order, you affirm that you are at least 18 years of age, in accordance with our terms of service.
Payment
Payment is due upon receipt of the invoice. We reserve the right to cancel the invoice if full payment with bank charges (if any) is not received by the end of the invoice due date.
If you cancel any unsettled order, we retain the right to disregard your future orders placed on the website or to issue a Proforma invoice only. Customer may settle their payment by Bank Transfer, FPS, credit card (with a limit of HK$50,000 per customer per month), Wechat/ Alipay as indicated during the checkout process. Payment by credit card is subject to a 3% surcharge, while 1% surcharge is applied for payment by Wechat/Alipay.
If you have difficulty in settling the full payment by the invoice due date, please communicate with the sales team in advance. On a case-by-case basis, we might accept a 50% deposit within the invoice due date, with the remaining 50% balance to be paid within 2 weeks from the invoice due date. The deposit is not refundable nor transferable, any late payment will be charged 3% interest.
Rarely, we may reject a card at our discretion after a review of associated fraud risk factors and transaction history - an order paid with such a card may also be cancelled and refunded. After you have made an offline payment, please send us a copy of your payment slip/screen.
Orders cannot be reserved or guaranteed prior to full payment being settled. If the payment is settled via cheque/wiring/ interbank transfer, please allow extra workdays for us to receive the fund. Delivery will only be arranged after full payment is well received.
Contract
At the point at which your payment is received by us, a legally binding contract will exist between you and the Company, but we reserve the right to refuse or amend any order up to the point of dispatch (for wines for delivery). We will always contact you if we have to amend your order. In registering on the site or placing any order for alcohol you confirm that you are over 18. No contract shall exist between us and anyone under 18 who attempts to order or to take delivery of alcohol. If our drivers are in any doubt about this they are instructed not to leave the goods and the sale will be cancelled.
Availability
We do our utmost to ensure that all wines offered on the website are available, but availability is limited, particularly in the case of the rare wines, and all products are offered subject to availability. Although we make every effort to ensure that wine stocks indicated on this website are correct and up-to-date, in some instances it is possible for a customer to pay for a wine on this site before we are able to be make updates to reflect the selling of the wine to another customer via other sales channels. In these situations we will make a full refund.
Pricing
For wines, prices are given per bottle (750ml) or as otherwise listed. Our general lists display the standard bottle price.
Whilst we make every effort to ensure the availability of wines offered with correct pricing, mistakes can occur. If a product is accidentally offered at an incorrect price, we reserve the right to refuse to supply at the incorrect price and will contact you to see if you wish to proceed with the sale at the correct price.
If we make a time-limited offer, any date given will be a guide only and we will not be obliged to fulfill orders up to that date. We reserve the right to change any price or offer without prior notice.
Engraved Products
We are not a professional laser cutting company, but we have the appropriate tools to help us achieve the desired effect. Engraving can only be done on a wooden case. The result could be affected by the quality of the wood, complexity of the design, and quality of the digital artwork. While we make every effort to be as accurate as possible, all dimensions and measurements indicated on our reference photos may vary from the specification set out in the machine. We are unable to guarantee the finished result and cannot be held responsible for these variations. In the unfortunate event that we fail to deliver the best outcome, there will be no refund or exchange of the items.
Delivery
Any indication as to an order's shipment, arrival, or local delivery is an estimate only. Such estimates are given in good faith and we will use our reasonable endeavors to meet them. We do not accept liability for any failure to deliver within that time. If you require your order urgently or on a specific day we will do our best to accommodate your request, in which case additional charges may apply.
Re-delivery will be charged if there is no one to receive and sign for the goods at the scheduled delivery date and time.
All orders placed and fully paid before 3pm (weekdays only) can be delivered the next work day (Monday to Friday). We do not deliver over the weekend or on public holidays. For Hong Kong local delivery please note that we do not guarantee a specific delivery time slot. Your order with us will be delivered during normal business hours. Apart from Tung Chung, we do not deliver to any other outlying islands in Hong Kong. For Discovery Bay, there's an additional surcharge of HKD350. Additional charges also apply for long/distance carrying or stairs involved. For delivery to JAS Logistics (52-62 Tsing Yi Road) or any other destinations that require an entrance/gate fee, this fee will be borne by customers too.
For appointments to pick up wines at our office, we may ask for a portion of the recipient's HK identity card (or other identification/travel document for foreign visitors) beforehand so we may verify their identity during the appointment. This is to ensure that goods are only released to the correct party.
When typhoon signal No 8 or the black rainstorm signal is hoisted by the Hong Kong Observatory, scheduled deliveries will be postponed to the next available work day.
For overseas delivery, please kindly check with the local authority on import regulations and tax rates. The amount you pay to us only covers the bottle value and delivery cost (excluding insurance). Any taxes, duties, and transportation risks will be borne by your side. In the rare event that you fail to pay the taxes or provide all the necessary documents before the clearance deadline, we will not be held responsible and the wines will be destroyed by destination customs. There will be no refund or exchange.
Acceptance
It is the receiver's responsibility to inspect the condition of any goods received including glassware and accessories, at the time of delivery. Any claims for short delivery or breakage or any other defect or deficiency must be notified to us or any third-party courier immediately. You will be deemed to have accepted the goods as satisfying as they delivered and in fulfillment of your order. You will not be entitled to reject them in any reason and we may refuse your claim thereafter.
Returns
All sales are final and are not subject to returns or exchange.
Ratings Information
Wine and whisky ratings listed on our website are for reference only. We will not be liable for any direct or indirect damages with respect to the accuracy of the information. We do not guarantee the ratings are up to date.
Quality Charter
We do our utmost to make sure that the goods are delivered to you in the best possible condition.
We undertake the proper safekeeping and storage of wines and whiskies in our possession and will act in good faith when purchasing and transporting the inventories, but we will not be responsible for the state and condition of wines/whiskies or whether the wines/whiskies correspond to the qualities which might be expected from its description.
The wine industry estimates that between 3 and 7 percent of all wines sealed with natural corks are ruined because of a natural fungus in corkwood that produces the chemical compound trichloroanisole, or TCA within the cork. TCA has a distinctive odor resembling moldy newspaper or a damp basement. In almost all cases of “corked” wine, the aroma of the wine is reduced significantly, and a heavily tainted wine is completely undrinkable. Since some of our wines are rare and limited, we cannot replace wines that have been ruined because of cork taint. We do not accept returns of corked wine nor do we refund for corked wine.
There is always an element of risk in the purchase of older fine wines/whiskies as their condition is inevitably variable. You are responsible for checking the condition photos either on the website or through the team before making a purchase. Please consider this risk carefully.
Warranty and Nature of wines/whiskies
We do not warrant the taste or drinkability of wines/whiskies purchased as drinkability and taste are subjective judgments. We make every possible effort to indicate accurately the conditions of back vintage items, those remarks are for reference only and the wines' actual condition may change during the stay in our cellar. We shall not be liable for any such discrepancies. Buyers must make appropriate allowances for natural variations in ullages, conditions of cases, labels, corks, and wine/whisky. The condition remark is an opinion only and shall not be relied upon by any Buyer. Label images appearing on the website or elsewhere are for illustrative purposes only and may not be relied upon to reveal imperfections in any products. We shall not be liable for errors or omissions in the website or other supplemental material. Prospective buyers are strongly recommended to check product photos with us before placing an order. In case of dispute, the Company reserves the right to a final decision. Where you have purchase from us then you accept that these wines may be subject to defects, imperfections, shortages, damage, and normal wear and tear. You accept that wines will be in the condition to be expected having regard to their age, provenance, and nature or where we have notified you of any such condition or defect. We do not accept liability for minor or inconsequential defects or imperfections.
Force Majeure
We shall not be liable for any failure to meet our obligations occasioned by circumstances beyond our reasonable control.
We may revise these terms and conditions at any time without prior notice. In case of disputes, the decision of our company shall be final and conclusive.
